Think Calgunners aren’t risking jail? Think again

Okay, some of the commenters at Kevin’s and Uncle’s seem to think that just because the Calguns folks went to the trouble of checking with attorneys about their innovative legal theories, they’re not really engaging in civil disobedience. It’s not breaking the law if you’re complying with the law, right?

Not if your local DA disagrees with your interpretation of the law. Not if you have to spend tens of thousands of dollars fighting to keep out of prison. You may be in the right, but you have to fight to prove it.

I’ve only been a Calgunner for a short time, and I’m already aware of a number of individuals, like Matthew Corwin, who’ve been targeted for prosecution, had their lawfully-owned rifles confiscated, and had to fight to keep from being crushed by the hammer of the State just because they exercised their Second Amendment rights as part of the mass civil actions Calguns has inspired.

One of the benefits of Calguns, and the point of the Calguns Foundation, is to make resources available to help these folks with righteous cases fight back against the overwhelming power of the State, brought to bear just because they dared to put themselves on the line.
Every case fought and won makes the next one easier and deters many more. Prosecutors like defendants who roll over and beg. More and more of the 58 DAs in California know that bringing these cases means 1) an expensive fight and 2) a losing battle for them.

    The key is stealth. Just do it, AND DON’T FARGING TALK ABOUT IT!

    CalGuns seems to be stuck in the ’60’s hippie mode: rebel against everything.

    In case anyone thinks that you can attrit those 58 DA’s down, they have another think coming. The relief for overburdented DA offices is to get Federal help, and you KNOW that the Feds will just print the money.

    Somehow, I don’t believe that acting like Critical Mass is going to win friends for the Second Amendment.

    You’re late to the game, RD. Only a few DAs remain now who are willing to try this, and they need to be fought.

    One of the less-publicized “victories” has been persuading lots and lots of cops to follow Calguns’ lead and become OLL owners themselves. It’s all about spreading knowledge of what the law is, rather than what they think it to be.

    this is more important than just another guy getting the shaft. If the victim here is a bonafide “good guy”, we have here the potential for a California version of Heller vs. DC.
