Federal authorities were so incensed by the Virgin Island’s [sic] prosecution of Clark — and so concerned other federal agents could similarly be prosecuted — that they removed all ATF agents from the Virgin Islands in 2008, a policy that continues today, the agency said.

Hmmm… I wonder if we could get the Upper Peninsula of Michigan reclassified as a Territory, and then jail an ATF agent. It’s worth a try, if it would get the Feds to remove all ATF agents from the UP!
“It is well recognized that federal law enforcement officers are immune from state criminal liability for actions that are taken within the scope of their employment as federal officers,” Sen. Charles Schumer, D-New York, wrote in a letter to Gov. de Jongh. “That principle… applies with equal force in United States territories.”
The Clark prosecution “has the potential to create a chilling effect on the operation of federal law enforcement throughout the United States’ territories,” Schumer wrote.
Considering that a lot of us think that immunity is bullshit in the first place, that’s not the best argument to make. Especially how it’s been used over time.
Sounds like he will be acquitted based on the merits of the case – not his magic federal get out of jail free card.
Hey, Michigammedave, you battened down for winter up there in the YouPee yet? Could be a bad one.
(The RD is a former military Youper)
From what I understand, the USVI is even more anti-gun than DC or Chicago. So much so they don’t even like ATF agents using guns down there. So let’s not go there thinking it’d be some kind of gunny paradise without ATF agents ruining our fun. Otherwise it’s just another banana republic.
Kinda wonder if the guy shot was the relative of a big-wig in government down there.
It may well have been legitimate self-defense; if so, I hope that comes out at trial. It’s the “You can’t be allowed to actually try a FEDERAL AGENT!” crap that ticks me off.
You can’t try a federal Agent? Isn’t that what the ATF said to the Idaho AG?
