A federal judge who struck down Virginia’s ban on gay marriage inaccurately attributed a quote from Declaration of Independence to the Constitution.

“Our Constitution declares that ‘all men’ are created equal. Surely this means all of us,” Arenda Wright Allen wrote in her original opinion, issued late Thursday.

Though the Fourteenth Amendment guarantees “equal protection” under the law, the Constitution does not include the phrase “all men are created equal.” That would be the Declaration of Independence.

The left is outrage mode because the President made a deal with someone from Georgia to get some less than far left judge nominated for one of the Circuits down there. I expect him to replace that nominee with this nitwit sometim this week.

On a side note, Guitar Center spent $1 million for Eric Clapton’s “Blackie” so that Fender could make clones. And both Gibson and Fender have bought other Clapton guits so they can take them apart to get measurements and x-rays so they can make replicas.

Why has no one done this for Angus and Malcom’s guitars? Angus, I can understand. he’ll tell you what his formula is (late 60’s Gibson SG w/humbuckers into a Marshal Plexi with the knobs turned to high noon). But why the disrespect to Malcom? That damn 1963 Gretsch Jet Firebird has played on every single AC/DC album since 1973. If he put a Stratocaster into the mix, it wouldn’t be AC/DC. Fender owns Gretsch. You’d think they could get their shit together.

EPA ‘clean coal’ rule would increase power prices by 70 or 80 percent

An Obama administration official has said that the new clean coal rules could increase electricity prices by as much as 80 percent.

Dr. Julio Friedmann, the deputy assistant secretary for clean coal at the Department of Energy, told House lawmakers that the first generation of carbon capture and storage technology would increase wholesale electricity prices by “70 or 80 percent.”

…..

“The precise number will vary, but for first generation we project $70-90 per ton (on the wholesale price of electricity),” Friedmann said. “For second generation, it will be more like a $40-50/ton price. Second generation of demonstrations will begin in a few years, but won’t be until middle of the next decade (2022-2025) that we will have lessons learned and cost savings.”

It must be nice having a lapdog media.

And don’t worry, Dr. Friedman. By 2025, inflation will have risen to the point that these cost increases will make these nearly doubled rates seem reasonable.

California Goes Shall Issue

Not immediately, but that sure looks like where we’re heading after the 9th Circuit’s decision in Peruta today.

Because the Second Amendment has always been an individual right to defend oneself, cases that—like these—uphold gun regulations because they do not offend the militia-based nature of the right are inapposite and should not factor into a historical analysis of the right’s scope. See, e.g., Heller, 554 U.S. at 605. And with these cases off the table, the remaining cases speak with one voice: states may not destroy the right to bear arms in public under the guise of regulating it.

And the money quote:

…San Diego County’s “good cause” permitting requirement impermissibly infringes on the Second Amendment right to bear arms in lawful self-defense.

I’m still reading through the decision, but basically, the lower court’s granting of San Diego’s motion for summary judgment was reversed because, among other things, self-defense must be considered “good cause” to issue the license to carry. All the caveats apply: it’s a 3-judge panel, not the full 9th; San Diego can still appeal.

Nonetheless, this bodes VERY well for the Calguns Foundation’s/Alan Gura’s Richards case, which was argued before the same panel on the same day, and may get us more of a slam-dunk ruling. We’ll see.
