The “Gun Show Loophole” is not a loophole

Now THIS is a loophole.

Bishop Hill reports that the CRU crew may escape prosecution for their crimes because there is a flaw in the law, according to the information commissioner’s office. Apparently, the FOIA is worded to make ‘lying like a weasel’ a summary, rather than indictable offence, and that means that a magistrate can’t try it more than six months after the crime.

That seems entirely remarkable to me. It means, as in this case, that if you only discover evidence of the crime more than six months after it happens, then they can get away scot free.

His Eminence had made an FOIA request for some emails, which the ‘imprisonment of information officer’ said they didn’t have, it had all been deleted, or eaten by the dog, or something. They no longer existed, so they were exempted from handing them out. Dead end. Except that some of those requested emails just showed up in Climategate.

Problem is, they only turned up two years after the request was made and turned down. So it supposedly is outside the time limit given in the Magistrates’ Courts Act 1980 s127.

Lie your ass off and then derail an investigation to hide your lies.

Just make sure you that do this for at least six months, so that you never have to pay up on the consequences of those lies.

Yet, in this same island nation, taking a swing with a bat at a guy with a knife who is burglarizing your home will always get you 2-5years.

You’re not needed, gentlemen

Democrat Rep. Carol Shea-Porter (D-Ipshit) has thought up a way to get the House health insurance reform bill passed as-is:

Get rid of the men’s votes.

U.S. Rep. Carol Shea-Porter, D-N.H., is coming under fire from political rivals for some things she said at a town hall meeting in Manchester on Saturday. Shea-Porter’s office said she was trying to use some humor when she said some women in Congress believe the men are holding up health care reform. But not everyone is laughing.”We go to the ladies room, the Republican women and the Democratic women, and we just roll our eyes at what’s being said out there,” Shea-Porter said. “And the Republican women said when we were fighting over the health care bill, ‘If we sent the men home, we could get this done this weekend.'”The line was followed by laughter from the crowd, and Shea-Porter’s office said the comments were meant to be tongue-in-cheek.

I’m sure that if, say, Senator Scott Brown (R-MA), were to say something along the lines of “You want to know how to get the budget balanced and SSI privatized, send the women home.” that Ms. Shea-Porter would have absolutely no problem with that and it wouldn’t cause even a ripple in the new cycle.

Like I always say: The Democrats apparently think that if one standard is good, two must be even better!

The Book Of Eli

I saw The Book of Eli over the weekend.  Good movie, well worth a matinee, The story is a little weak, but the action is top notch and the acting solid.  And after you get the reveal at the end, you’ll spend the next few days going over the whole movie in your head and kicking yourself over how you missed something so obvious (since you get clues from the first scene to the end).

In the meantime, I loved Alan Gura’s snarky response to the NRA’s attorney Paul Clement stealing some of Gura’s oral argument time in McDonald:

“The suggestion that I wouldn’t present all the arguments to the Court was uncalled for. I hope that this time Paul understands that handgun bans are unconstitutional.”

Y’all who are non-lawyers may not get this, but that’s about as pissed-off rude as lawyers can be to each other in public. Snarky!

(By way of background, at GBR-IV Gura was repeatedly interrupted by a particular blogger in the audience, and I just about died of embarrassment every time Gura felt it necessary to say “let me finish, please.” Lawyers are a lot of things, but they are above all else civil, and although I’m sure Gura was itching to say something much stronger, he just couldn’t do it. If he’d had to say that particular phrase in the courtroom, every other legal professional within hearing would think something along the lines of “Oooooh SNAP!” Look, when you’re in a roomful of people who are listening to Alan Gura and want to hear what he has to say, please exercise the discipline to wait until he’s finished, okay?)

As we’ve been warning the left since day one, once the government is given control over something, they consider it theirs.

Case in point, the UK Royal Society for Public Health has issued what they themselves are calling a Public Health Manifesto

  1. A minimum price of 50p per unit of alcohol sold
  2. No junk food advertising in pre-watershed television
  3. Ban smoking in cars with children
  4. Chlamydia screening for university and college freshers
  5. 20 mph limit in built up areas
  6. A dedicated school nurse for every secondary school
  7. 25% increase in cycle lanes and cycle racks by 2015
  8. Compulsory and standardised front-of-pack labelling for all pre-packaged food
  9. Olympic legacy to include commitment to expand and upgrade school sports facilities and playing fields across the UK
  10. Introduce presumed consent for organ donation
  11. Free school meals for all children under 16
  12. Stop the use of transfats

Make sure you read that whole list. Especially #10.

“We’ve paid to keep your body functioning for as long as possible. After you’re done with it, it is ours.”

I’ve got nothing against organ donation. Giving my body up for science when I’m done with it myself (and then they can pay to burn it).

But not everyone is as liberal about their carcass as I am with mine.

It’s legal when the president says it’s legal

I know I missed this story when if first hit. But I’ve got an 3.8 grade average as an excuse.

Obama quietly issues ruling saying it’s legal for the FBI to break the law on accessing phone records

Following the report earlier this week that the FBI regularly broke the ECPA law, in obtaining information from telcos without going through the proper process (and, in some cases using just a post it note!), some interesting details from the full report have come to light. The two key ones? First, “the Obama administration issued a secret rule almost two weeks ago saying it was legal for the FBI to have skirted federal privacy protections.” And, second, the original idea to use these bogus “exigent letters” didn’t come from the FBI, but from an AT&T employee.

It’s as though he’s a combination of Bush, Nixon and Carter.

It must be the Carter part that keeps the left from issuing the “He’s just like Hitler” screeds and demanding he be prosecuted on this.

Also, about the wording from the link: I know that the Executive Branch doesn’t issue “rulings”. He/It issues Executive Orders that can change certain rules. The wording may be wrong, but the fact is still valid.

UPDATE: I’m also waiting for the cries of “War Criminal” pointed at Obama over this factoid as well.

Taxpayer Subsidized Press

Over at The Progressive there is an interview where a couple of Newspaper guys talk about using taxpayer funds to keep journalism alive, and they discuss the danger of government censorship.  It’s worth a read.

Yes, I read The Progressive, don’t you?  I mean, reading or listening to NPR is great and all, but for real Left Field stuff that is written by people who are NOT psychotic (COUGH! FireDogLake COUGH!), The Progressive is he place to stop (if for no other reason than it is good to get your blood pressure up every now and again).
