Yeah, I need to keep up with this better

The rehearing by the full DC Circuit court was denied and the three judge panel decision on Parker v DC stands. DC gets 90 days (I think) to appeal it to the SCOTUS.

Eugene Volokh is calling the odds at the SCOTUS hearing the case at “well over 50%”.

During the ride back from Boomershoot, David filled me in on ways that the SCOTUS could hear the case and still not change anything, and I am hoping that he’ll have time to let the rest of you know. I could paraphrase it, but I wouldn’t do it justice (pardon the pun).

Rivrdog asks “What if we win?”, and has some good hpyotheticals in response.

Myself, being the pessimist that I am, and having heard David’s ideas about the SCOTUS being able to limp-wrist the case, would be at least somewhat content if they denied hearing it. It would minimally cement the “Individual Right” as was the intention of the authors of the Bill of Rights.

Doing it right, In Kansas

So far, anyway.

Apparently, as they dig through rubble and come across guns, they are tagging them and marking the location where they are found and taking them for storage. For the safety of everyone involved, I don’t think it’s unreasonable. Of course, that’s only based on how it’s being conducted and how easily they return them.

If you don’t have the gun on you, I don’t know why they wouldn’t be in a safe or locked hard case. If I’m abandoning my abode due to an oncoming tornado, I’m grabbing my SHTF gear (including and especially firearms) and hauling ass. Everything else is locked down and in. sure, whatever is inside the safe is probably damaged, but like a loose firearm is going to fare any better.

Now we’ll see how easily the owners get their firearms back. Make, model and serial number should do the trick. And let’s hope the state isn’t keeping a list of who picks up what.

Handgun License Requests Soar

In the two weeks since the deadliest shooting in U.S. history, Portland-area residents are looking to carry concealed handguns at a greatly increased rate.

Since the April 16 killings of 32 people at Virginia Tech University, sheriff’s agencies report that weekly requests for concealed handgun licenses have nearly tripled in Multnomah County and doubled in Washington County.

The Oregon Firearms Academy in Lebanon added extra personal safety classes in May and June because of increased demand. Still, the classes are booked solid into October. Vivian Abbott, the academy’s office manager, said she received more than 40 calls about gun safety classes in the first days after the Virginia Tech shootings.

If gun rights are civil rights, why would anyone feel the need to hide the fact that they own one?

Forget that it is a wholly ignorant statement. If I do that, I can think of a couple reasons why the owner of firearms would want to keep said fact of ownership a secret: Thieving neighborhood kids, Gun Bigot employers and Government confiscation plans.

Each of those applies to the issue Sully is speaking of: The publication of a list of CCW holders in Tennessee by The Tennessean.

I wonder if He of the Eternal Bleeding Heart would mind registering as a homosexual and then having his name and address published by a large metro newspaper? I mean, if being gay is a civil right, why would he want to hide it?

Resistance is NOT Futile

One of the most enjoyable aspects of staying at Trib’s Place during Boomershoot was the lively and intellectually engaging discussions late into the night. At one point, someone made the comment that resistance to a future American military acting under dictatorial orders would be futile. Phil and I had lots of responses to that one, you may be sure, but I wish I’d been able to point to this essay:

The Law of Unintended Consequences decreed that there would be two unexpected results of this Clintonista constitutional misbehavior. The first was the importation and sale within a few months of several millions of semi-auto rifles (principally SKS and AK-variants) into the U.S. This was in anticipation of, and defiance of, the so-called “Assault Weapons Ban.” Indeed, this was more rifles of these types than had been sold in the previous TWENTY YEARS. And it was in a political climate where it was fully expected that the next law would call for the confiscation of such weapons. Why, then, did this massive arming take place? Were we buying these rifles merely to turn them over later? When the Clintonistas realized that we were not buying these rifles to turn them in, but to turn ON THEM if they became even more threatening to our liberties, it gave them considerable pause. I am told the analysts in the bowels of the J. Edgar Hoover building were particularly impressed…the FBI became very much more solicitous of our sensibilities and sought at every turn to avoid a flashpoint. During each little potential Waco– the Republic of Texas, the Montana Freemen, etc– the FBI would seek out local militia leaders and ask their advice, seeking their opinions with what sounded like real concern.

The best answer that I recall to one of these FBI queries came from Bob Wright, commander of the 1st Brigade, New Mexico Militia. When asked if he and his friends would actually go to the scene of a future Waco in another state to assist the potential victims, Bob replied, “Why would I want to do that? There’s plenty of you federal SOBs around here.” This was a perspective the Fibbie had not considered before, and it showed on his face.
