A Hofstra University student being held in a headlock at gunpoint by an intruder was accidentally shot and killed by a police officer who had responded to the home invasion at an off-campus home, police said Saturday.

Junior public relations major Andrea Rebello was shot once in the head early Friday morning by an officer who opened fire after the masked intruder pointed a gun at the officer while holding the 21-year-old student, Nassau County homicide squad Lt. John Azzata said.

In a tense confrontation with the officer, gunman Dalton Smith “menaces our police officer, points his gun at the police officer,” Azzata said. The officer opened fire, killing Smith and his hostage.

Azzata said the Nassau County police officer fired eight shots at Smith, who police described as having an “extensive” criminal background. Smith was hit seven times and died. Rebello was shot once in the head.

Sadly, that officer still had a better hit/miss ratio than the officers who responded to the the Empire State Building killer.

    Heh. Not every cop can be an iron-sight pistol sniper. I practiced that shot a lot, but never had to take it, so who am I to say nay?

    I don’t want him to be a sniper, RD. I just want them to be able to not fail the hostage drill. You may have practiced that shot, but from what I’ve seen of the Muni & County patrol in my area, and apparently other munis across the nation, they go to the range only as often as they have to (and some not even that often).

    I would also like folks to be responsible (and have the ability) to cover their own ass so that they don’t end up in a headlock looking down the wrong end of a constable’s sidearm.

    Last year a friend of mine in WA, a LE had the same situation, responded to a hostage situation with hubby and wife. Hubby had wife in neck hold and was drawing a knife when my bud walked into the room obviously to stab wife before being arrested. My bud fired one shot across bed into the head of the hubby dropping him. Shot was within 1 inch of less of hitting wife, if she had move even slightly it would have gone bad. Arm chair commandoes and go F*&^* themselves. These after action hero’s who have never in their lives had to deal with ANYTHING like this suddenly and with fractions of a second to respond and decide are not worth listening to or responding to.

    Sadly there seems to be a lack of training and leadership in this department.
    Just an off the cuff observation.
    I was Navy Law Enforcement in the last 5th of my career. Training, Training, Training.
    The family needs to get a Grade “A” Race Horse Lawyer.
