Police Stop, Handcuff Every Adult at Intersection in Search for Bank Robber

Held for almost 2 hours and handcuffed. A couple of gems from the article:

“We didn’t have a description, didn’t know race or gender or anything, so a split-second decision was made to stop all the cars at that intersection, and search for the armed robber,” Aurora police Officer Frank Fania told ABC News.

and

The actions of the police have been met with some criticism, but Fania said this was a unique situation that required an unusual response.

“It’s hard to say what normal is in a situation like this when you haven’t dealt with a situation like this,” Fania said. “The result of the whole ordeal is that it paid off. We have arrested and charged a suspect.”

Um…4th Amendment?

    To quote Eugene Volokh: “It therefore sounds to me like the police might be facing 19 lawsuits (one in which the jury might not be that sympathetic to the plaintiff, and 18 in which they will likely be much more sympathetic), as well as one likely pretty solid suppression-of-evidence motion.”

    I’ll give 12 to 7 once this makes it to the supreme court, the leftist judges will all fall in line under exigent circumstances excuse everything, and the conservative judges will line up under 4th Amendment violation

    First, shoot all the lawyers….well, not ALL of them, just the ones who are too stupid or recalcitrant to see where the legal action belongs in this case: CRIMINAL court. Indict every cop who took part, and try them for all the crimes they committed, most of which center around kidnapping. After the cops are in jail, THEN sue for damages.

    The operative constitutional issue here is that probable cause never existed for any of the arrests, and reasonable suspicion never existed for any of the stops before suspect info was gathered at the bank, so none of this has the protection of the color of law.

    Indict, convict and imprison. If you don’t, all the decades of search and seizure law and legal precedent just got blown away by the wind of tyranny on that street in Aurora.

    If they’re not going to hit cops with criminal charges over breaking and entering, animal cruelty, etc, they’re sure as hell not gonna charge over some inconvenienced drivers.
