Can the DOJ force you to give up your encryption passphrase or otherwise force you to decrypt your encrypted data?

    Ain’t going to fly.

    You cannot force a defendant to testify without giving him full immunity first. We either have a fifth amendment, or we do not.

    Heh. Guess the DOJ’s vaunted techs can’t crack the encryption on their own?

    But yeah, tricky. You could logically treat it as an extension of a search warrant; the court can issue a search warrant to enter your house for evidence.

    Assuming courts nowadays remember how that works…
