Stupid Judiciary Tricks

Of course, we’ll be talking about the 9th Circuit today. They laid a pair of goose eggs yesterday, each of which deserves ridicule in its own post, but I don’t have that kind of time.

First, one of their three-panel groups decided that lying about military award and commendations shouldn’t be a crime because the statute violates the liar’s 1st Amendment Rights.

I can almost see where they’re coming with this if it was just about media attention. Generally, once the liar is discovered, the shame is just as great as the previous accolades (unless you’re a leftist spewing anti-war propaganda against the Bush Administration), but in almost all other cases the lie is part of a larger con. If you make the smaller parts of the con illegal, it deters most of those who would work the con itself.

Secondly, another three judge panel of the 9th Circuit decided that mud that washes off of dirt roads when it rains is “pollution”.

Yes, you read that right! Mother Earth is a self polluter.

They wrote that the federal government now has to task the EPA with writing new regulations on how to control this “pollution” and then implement the upgrades on all currently existing logging roads and build future roads to those specifications.

It is a good thing that there are plenty of existing homes on the market for sale, because building them just got more expensive.

Lastly, some anti-mining/drilling activists got together and sued to stop the State of Idaho from issuing hauling permits to Conoco and Exxon so that the companies can move their mining/drilling equipment down Hwy 12.

And even after the state got the companies to agree to each buy $10 Million dollar bonds to cover any road repair costs and reasonable stipulations about traffic hold-ups, a 2nd District judge put a halt to the transport of the equipment.

I wonder how many jobs in Idaho are being held up so that Mother Gaia isn’t “violated” by eevviill Capitalists?

    Does that mean I can now go around in my black rent a cop uniform with a shiny 7 pointed gold plated badge and holstered real-looking model Glock and allow anyone who looks at me to believe I’m a police officer? After all, I’m not claiming to be a peace officer! Heavens no! I’m not attempting to impersonate a peace officer. I’m simply expressing my 1st amendment Constitutionally guaranteed God given rights.

    Any bets about how long I can get away with that?

    Any bets regarding what the dildo-brains in the 9th Circuit would think of it if I dressed up like a US Marshal’s court house guard and wandered through their chambers and court room exercising my 1st amendment rights sp accoutered?
